Constitutional amendment to affirm the Legislature's authority to limit the amount of recovery for noneconomic damages in any claim for personal injury

Description
This constitutional amendment resolution was introduced by KMS to empower the legislature to enact award limitations. It was introduced in expectation of an upcoming opinion from the Kansas Supreme Court testing the state’s limit on pain and suffering awards in personal injury lawsuits. With the legislature now finished for 2010 KMS will now focus on the Kansas House elections in November to prepare for a push to pass a similar resolution during the 2011 session. Any resoltion passed in 2011 would in all likelihood be voted on during the 2012 elections.
