We are still waiting for a decision by the Kansas Supreme Court on the fate of the legal challenge to the centerpiece of Kansas’ tort reforms, the $250,000 cap on pain and suffering, or “non-economic” damages awards. The importance of this one reform to the continued stability in our professional liability environment cannot be overstated. If the Supreme Court strikes down the law, it will plunge Kansas back into a medical malpractice crisis, and the medical malpractice premiums you pay could double in 2 to 3 years.
KMS will need the support of the Kansas Legislature to restore the cap on non-economic damages. We need your help to make sure that our political action committee, KaMPAC, has the resources to help elect candidates who support tort reform and are friendly to medicine. You can be certain that the trial lawyers will vigorously oppose us, and will support legislators who will try to block our efforts to re-enact the cap.
